Drug Tests Violate USDA Workers' Privacy, DC Circ. Says

Law360, New York (June 08, 2012, 8:16 PM ET) -- The D.C. Circuit on Friday revived a union's constitutional challenge to the U.S. Department of Agriculture's random drug testing policy for employees at residential schools for at-risk youth, saying the government hadn't sufficiently justified the intrusion into the workers' privacy.

Calling the policy “a solution in search of a problem,” the appeals court overturned U.S. District Judge Beryl A. Howell's grant of summary judgment to the secretary of agriculture and the chief of the U.S. Forest Service, which had upheld the USDA's policy regarding drug testing...
