Law360, New York (June 13, 2012, 6:14 PM ET) -- The Ninth Circuit said on Tuesday that state employees could not use a broad civil rights law to bring otherwise-barred lawsuits against state governments alleging violations of the Americans with Disabilities Act.
The appeals court said Section 1983 of Civil Rights Act of 1871, which allows private individuals to sue if their federally ensured rights are deprived by state or local governments, was not applicable to laws for which Congress had provided a detailed system of remedies, such as the ADA.
