Dukes Doesn't Bar Class Cert. In Wells Fargo Wage MDL: Judge

Law360, New York (August 10, 2012, 8:33 PM ET) -- A Texas federal judge on Friday certified two classes of Wells Fargo & Co. mortgage consultants that claim the bank and its predecessors stiffed them on overtime, rejecting the argument that the Supreme Court's Dukes decision precluded collective certification.

U.S. District Judge Gray H. Miller — who is overseeing five consolidated cases against Wells Fargo — said the two groups of mortgage officers had met the standard for conditional certification, though he stressed that the Fair Labor Standards Act's early-stage class requirements are lenient.
