A Look At 16 Years Of EEA Prosecutions

Law360, New York (September 19, 2012, 12:18 PM ET) -- Since the Economic Espionage Act was enacted 16 years ago, the United States has obtained approximately 124 indictments under the EEA’s two separate provisions. This is a statistically meaningful number to draw conclusions about: (1) the location of the cases, (2) the extent of foreign government involvement, (3) relationship of defendant to the victim, (4) nationality of the defendant/purpose of theft, (5) type of trade secrets stolen, (6) adequacy of protective measures, (7) dispositions and (8) sentences.[1]
