Law360, Philadelphia (January 02, 2013, 3:07 PM ET) -- The Pennsylvania Supreme Court ruled Friday in a precedential decision that under the state’s unemployment compensation laws, employees who accept an early retirement plan offered as part of an employer-initiated workforce reduction can qualify for unemployment benefits.
The 4-2 decision found no distinction between an employee opting for an early retirement package and accepting a voluntary layoff, determining that a shipping clerk who took advantage of an early retirement offer was due for benefits.
