Mich. Benefit Tax OK Under ERISA, Insurers Tell 6th Circ.

Law360, Washington (February 1, 2013, 7:02 PM ET) -- The Michigan Association of Health Plans sided with the state on Wednesday and pushed the Sixth Circuit to uphold a heath benefit claims tax law, saying the state's Medicaid program stands to lose more than $1 billion if the federal Employee Retirement Income Security Act preempts the statute.
