Law360, Los Angeles (February 01, 2013, 4:48 PM ET) -- A California appeals court on Thursday rejected Oracle Corp.’s bid to reverse a lower court ruling that an agreement resolving Oracle's alleged poaching of former Hewlett-Packard Co. executive Mark Hurd required Oracle to continue to run its software on HP servers.
In the Santa Clara County Superior Court in August, Judge James P. Kleinberg said the plain language of the 2010 settlement "can only be reasonably interpreted as requiring Oracle to continue offering its product suite on HP's Itanium platforms."
