10th Circ. Won't Revive Ex-Amtex Guards' Age Bias Claims

Law360, New York (September 13, 2013, 8:22 PM ET) -- The Tenth Circuit upheld the dismissal Wednesday of age discrimination claims brought against Amtex Security Inc. by security guards who worked for the U.S. Army pursuant to a Amtex contract, but were fired after the company started using a new physical agility test in 2010.

A three-judge appellate panel affirmed a lower court in Oklahoma's decision to grant summary judgment to Amtex on the the plaintiffs' Age Discrimination in Employment Act claims for disparate impact and intentional discrimination.
