Citgo Escapes Workers' OT Claims In 5th Circ.

Law360, Los Angeles (November 12, 2013, 5:55 PM ET) -- The Fifth Circuit refused Tuesday to revive claims by Citgo Refining and Chemicals Co. LP console supervisors who alleged they were misclassified as exempt from overtime pay under the Fair Labor Standards Act, ruling the employees didn't produce key evidence requested for discovery.

Affirming a Texas federal judge's dismissal of the claims, the appeals court agreed that the plaintiffs defied the judge's order by destroying or failing to preserve materials detailing their job duties and work hours.
