Dodd-Frank Whistleblower Can't Get Jury Trial, Judge Says

Law360, Washington (November 12, 2013, 5:37 PM ET) -- A Georgia federal judge on Tuesday dismissed claims seeking punitive damages and a jury trial in a whistleblower suit brought by a former compliance manager of BlueLinx Holdings Inc., ruling that whistleblowers have no right to a trial by jury under the Dodd-Frank Act.

U.S. District Judge J. Owen Forrester dismissed the claims from plaintiff Jeffrey Pruett’s suit accusing BlueLinx of retaliating against him after he reported alleged violations to the Public Company Accounting Oversight Board and the U.S. Securities and Exchange Commission.
