Employers Try To Keep Age-Claim Waivers Valid

Law360, New York (August 08, 2008, 12:00 AM ET) -- With more reductions in force on the horizon, companies need to take extra steps to ensure that the release forms they make older workers sign before mass layoffs comply with federal age discrimination laws.

Release forms that are out of date or use unclear language have been enough for some courts to invalidate them altogether, and an unenforceable release means companies that already gave employees severance packages in exchange for waiving age claims could end up being dragged into a purported class action for age discrimination....
