10th Circ. To Rehear Hydro Appeal Over Mine Permit

Law360, New York (August 26, 2009, 2:13 PM ET) -- A federal appeals court has agreed to rehear an appeal over whether drilling company Hydro Resources Inc.'s plans to build a uranium mine in northwestern New Mexico should fall under federal or state jurisdiction.

The U.S. Court of Appeals for the Tenth Circuit granted Hydro an en banc rehearing in its appeal of a decision designating the company's property near Gallup, N.M., part of the Navajo-based community the Church Rock Chapter.
