Law360, New York (August 28, 2009, 3:14 PM ET) -- A federal appeals court has ruled it does not have jurisdiction over a regulatory decision to exempt an Entergy Nuclear Operations Inc. facility in New York from fire safety regulations, paving the way for the petitioners to take their case to the district court.
The U.S. Court of Appeals for the Second Circuit on Thursday dismissed the case without prejudice after concluding that it did not have jurisdiction under the Hobbs Act to review orders of the U.S. Nuclear Regulatory Commission dealing with exemptions.
