Law360, New York (April 08, 2011, 3:06 PM ET) -- Subsidiaries of Massey Energy Co. argued on Thursday in West Virginia that a $20 million settlement with federal regulators precludes a current suit by environmental groups over selenium pollution.
Massey subsidiaries Independence Coal Co. Inc. and Jacks Branch Coal Co. filed a motion for summary judgment in the U.S. District Court for the Southern District of West Virginia, saying a 2008 settlement over pollution violations with the U.S. Environmental Protection Agency precluded the suit.
