Law360, New York (March 09, 2012, 6:36 PM ET) -- The Federal Energy Regulatory Commission told the owner of a 1.1 million-kilowatt-hour Michigan hydroelectric dam Friday to do a better job regulating the flow of the Thornapple River or face civil penalties.
Commonwealth Power Co., which owns a total of five hydroelectric power facilities in southwestern Michigan, failed to control fluctuations of the Middleville, Mich., dam's reservoir level, and did not adequately report deviations in flow, according to a compliance order FERC issued Friday.
