Law360, New York (April 09, 2012, 7:20 PM ET) -- The James River Insurance Co. hit R&D Mining Coal Co. with a lawsuit in Pennsylvania federal court Friday, saying it has no duty to indemnify R&D against a suit stemming from a methane explosion that killed a miner.
James River says it had no obligation under R&D's policy because the mining company's egregious conduct had caused the explosion in the Schuylkill County, Pa., mine that killed Dale Reightler, leading to a suit by his widow for which R&D is seeking indemnification.
