Judge Greenlights Miners' Fraud Suit Against Jackson Kelly

Law360, New York (June 08, 2012, 8:05 PM ET) -- A West Virginia judge will reportedly allow the families of three now-deceased coal miners to pursue claims that Jackson Kelly PLLC fraudulently hid evidence that showed the miners had black lung disease, according to a Thursday report.

The ruling from Raleigh County Circuit Judge Harry L. Kirkpatrick III, struck down a motion to dismiss filed by Jackson Kelly, letting the families continue their fraud case against the firm, according to a report published June 7 in The Charleston Gazette, a West Virginia newspaper.
