Oil Group Tells DC Circ. Biofuel Minimums Are Unreachable

Law360, New York (June 22, 2012, 1:37 PM ET) -- The American Petroleum Institute has revved up its attack on cellulosic ethanol mandates imposed by the U.S. Environmental Protection Agency, arguing in a D.C. Circuit brief Thursday that the minimums are impossible to meet given the fuel’s scarcity.

At issue are specific amounts of the alternative fuel that gasoline and diesel refiners must blend into their products to avoid paying a penalty. The API, which sued earlier this year to have the requirements scrapped, says its member companies forked over $17 million because there wasn’t any...
