Union Pacific Says Asarco's $33M CERCLA Suit Is Time-Barred

Law360, New York (June 22, 2012, 2:28 PM ET) -- Union Pacific Railroad Co. asked a California federal court on Thursday to throw out claims from mining giant Asarco LLC seeking contribution for $33 million in Superfund cleanup costs, arguing that the allegations are time-barred because of a 1989 settlement.

The court dismissed CNA Holdings LLC from the suit earlier this month for the same reason, finding that Asarco's 23-year-old agreement settling Comprehensive Environmental Response, Compensation and Liability Act claims at a 66-acre parcel in northern California known as the Selby Site triggered a three-year statute...
