Chesapeake-Encana: Antitrust Lessons For Energy Cos.

Law360, New York (July 10, 2012, 1:41 PM ET) -- Recently published reports of land acquisition and lease activities between Chesapeake Energy Corp. and Encana Corp. senior executives have purportedly exposed those companies to a U.S. Department of Justice antitrust investigation, and may, if accurate, expose the companies to civil antitrust claims or shareholder derivative suits. This is the second DOJ investigation into oil and gas lease arrangements this year, which highlights the risks that energy companies face when discussing lease arrangements with their competitors.
