D.C. Circuit Will Hear FERC's Amaranth Action

Law360, New York (December 07, 2007, 12:00 AM ET) -- Setting up a show-down in a federal appellate court in the coming week, the Federal Energy Regulatory Commission denied Amaranth's motion to stay $291million in fines pending an appeal.

On Thursday, FERC formally denied Amaranth's request for a stay of the $291 million show-cause order until the U.S. Court of Appeals for the District of Columbia's rules on it.

On the same day, Amaranth filed an emergency motion with the the D.C. Circuit Court requesting the stay, as well as expedited consideration of the order itself....
