Law360, New York (April 25, 2008, 12:00 AM ET) -- The war of words between justices involved in Massey Energy Co.'s appeal of a $240 million verdict has intensified, with one justice refusing to recuse himself from the case unless another justice does the same.
West Virginia Supreme Court Justice Larry Starcher, who has been asked to recuse himself from Massey's appeal, said on Friday that he would not step down unless Justice Brent Benjamin did as well.
