Utah Agrees To Join Radioactive Waste Suit Defense

Law360, New York (August 29, 2008, 12:00 AM ET) -- Utah on Tuesday agreed to become a defendant in a lawsuit that will determine whether a company can import foreign low-level radioactive waste into the state.

EnergySolutions Inc. sought a declaratory judgment against the Northwest Interstate Compact on Low-Level Radioactive Waste Management in the U.S. District Court for the District of Utah in May claiming that the federally-chartered body does not have the right to stop foreign radioactive waste from being stored at a facility in Clive, Utah.
