Law360, New York (April 27, 2009, 12:00 AM ET) -- The U.S. Supreme Court has agreed to take up a case that examines the standard of review the Federal Energy Regulatory Commission can allow for challenges to electricity rates.
The high court agreed Monday to hear arguments on the question of whether the Mobile-Sierra doctrine can be applied to a dispute over New England electricity rates.
The case stems from a long-running dispute over FERC's controversial approval of a settlement that effectively reformed New England's electricity capacity market.
