Law360, New York (June 24, 2009, 12:00 AM ET) -- In a victory for the Sierra Club, the Michigan Supreme Court has declined to hear the state's appeal of a judgment that its discharge permit program for large-scale animal farms violates the Clean Water Act by failing to regulate manure pollution.
In a 5-2 order on Tuesday, the Michigan high court denied the state's bid for an appeal of the State of Michigan Court of Appeals' judgment against the state's Department of Environmental Quality.
