BNSF Disputes Mont.'s Indoor Air Quality Order

Law360, New York (December 08, 2009, 4:00 PM ET) -- BNSF Railway Co. is asking a federal judge to overturn a state order requiring it to mitigate certain harmful chemicals in indoor air in structures around a rail depot in Livingston, Mont., where the company has been dealing with pollution for the past 20 years.

BNSF filed its motion for summary judgment Monday in the U.S. District Court for the District of Montana, arguing that the Montana Department of Environmental Quality had no basis to require BNSF to remediate those chemicals.
