Md. Hits Mirant With Landfill Seepage Claims

Law360, New York (April 07, 2010, 3:47 PM ET) -- Maryland officials have sued Mirant Mid-Atlantic LLC, alleging the power company's coal combustion waste disposal site polluted nearby water in violation of the Clean Water Act and state law.

Poor construction and operation of Mirant's Brandywine Landfill have allowed contaminated leachate to seep from the disposal pits into the nearby Mataponi Creek and the Merkle Wildlife Sanctuary, according to the civil complaint filed Friday in the U.S. District Court for the District of Maryland by the Maryland Department of the Environment.
