Law360, New York (June 30, 2010, 1:19 PM ET) -- The Natural Resources Defense Council is suing the U.S. Food and Drug Administration for its alleged failure to respond to a petition from the environmental action group seeking a ban on the use of bisphenol A in food packaging.
NRDC asked the U.S. Court of Appeals for the District of Columbia Circuit on Tuesday for a writ of mandamus requiring the FDA to respond to the petition, which the group sent in October 2008.
