National Coal Settles Suit Over Selenium Discharges

Law360, New York (September 08, 2010, 6:21 PM ET) -- National Coal Corp. has settled a selenium pollution suit for $80,000, ending a case brought by the Sierra Club and other environmental groups that accused the mining company of contaminating rivers in eastern Tennessee.

In a final order entered Friday in the U.S. District Court for the Eastern District of Tennessee, Judge Thomas W. Phillips approved a consent decree under which National Coal agreed to pay $40,000 to the Tennessee Parks and Greenways Foundation for the purchase of new protected land, and another $40,000 in attorneys'...
