Law360, New York (May 04, 2011, 4:43 PM ET) -- The Seventh Circuit on Wednesday rejected Appleton Papers Inc. and NCR Corp.’s bid to block $2 million in settlements that a group of companies agreed to pay the U.S. and Wisconsin to help remediate the nation’s largest Superfund site.
A three-judge panel ruled that Appleton and NCR — intervenors in the governments’ suit against the settling companies — failed to show that a Wisconsin district court abused its discretion in approving consent decrees that set forth a cleanup of polychlorinated biphenyl-contaminated Lower Fox River.
