Law360, New York (June 27, 2011, 7:16 PM ET) -- A California appeals court ruled Friday that the California Air Resources Board can advance plans for a cap-and-trade system to limit greenhouse gas emissions as it challenges a lower court ruling that it failed to adequately consider alternatives.
The state First District Court of Appeal stayed the enforcement of a May 20 writ from California Superior Court that enjoined further rulemaking and implementation of cap-and-trade until ARB rectified alleged failings under the California Environmental Quality Act.
