Enviros Sue Union Pacific, BNSF Over Air Pollution

Law360, New York (October 19, 2011, 2:58 PM ET) -- Three environmental groups filed suit in federal court Wednesday against Union Pacific Corp. and BNSF Railway Co., California’s two biggest rail yard operators, claiming diesel-based air pollution from their operations exceeds safe levels.

Led by the Natural Resources Defense Council, the groups accuse the operators of exposing people who live near 16 California rail yards to dangerous amounts of particulate matter, in violation of the Resource Conservation and Recovery Act.
