Judge Denies Green Group's Push To List Sage Grouse

Law360, New York (February 03, 2012, 8:35 PM ET) -- An Idaho federal judge on Thursday denied an environmental group's bid to force the U.S. Fish and Wildlife Service to classify the sage grouse as an endangered species, citing a settlement in related litigation that set a deadline of 2015 for the FWS.

U.S. District Judge B. Lynn Winmill granted FWS's motion for summary judgment and said that the determination that the risk to the sage grouse was moderate was not made arbitrarily or capriciously.
