Law360, New York (February 21, 2012, 7:50 PM ET) -- A federal judge on Thursday remanded a suit over an ExxonMobil Oil Corp. oil spill into Montana's Yellowstone River, rejecting the oil giant's contention that landowners fraudulently added an Exxon supervisor to the suit to keep it in state court.
The Montana landowners' suit would have belonged in federal court only if each party had come from a different state, but they can legitimately pursue claims against Jason Montgomery, a terminal superintendent for the pipeline and a Montana resident, U.S. District Judge Richard Cebull ruled....
