NY Court Upholds Fracking Ban In Town's Row With Anschutz

Law360, New York (February 21, 2012, 10:17 PM ET) -- A New York state judge on Tuesday upheld the town of Dryden's ban on hydrofracturing, rejecting natural gas company Anschutz Exploration Corp.'s contention that the ban is preempted by state laws that prevent regulation of the oil and gas industry on a local level.

New York Supreme Court Justice Phillip Rumsey said the state's Oil Gas and Solution Mining Law — which prevents towns from regulating oil and gas companies except for purposes of maintaining local roads and collecting local taxes — only preempts local regulations...
