2nd NY Local Gas Drilling Ban Upheld

Law360, New York (February 24, 2012, 7:49 PM ET) -- A New York state judge on Friday upheld a ban by Middlefield, N.Y., on natural gas drilling, the second time in less than a week that a judge has affirmed a municipal ban on the controversial practice.

Acting State Supreme Court Justice Donald F. Cerio Jr. rejected the contention by a town landowner that the ban was preempted by state laws that prevent regulation of the oil and gas industry on a local level.
