Law360, New York (May 01, 2012, 2:49 PM ET) -- A New Jersey federal judge on Monday threw out an environmental advocacy group's suit demanding that the U.S. Environmental Protection Agency force the state to better regulate stormwater runoff into the Delaware River, ruling the EPA had the right to determine whether or not to act.
The Delaware Riverkeper Network argued that the New Jersey Department of Environmental Protection has inadequately regulated municipal storm runoff and accused the EPA of violating the Clean Water Act by failing to intervene.
