Law360, New York (June 29, 2012, 4:39 PM ET) -- The Ninth Circuit ruled Friday that the federal government could collect intangible environmental damages under California law, backing a jury’s $29 million award against CB&I Constructors Inc. related to a 2002 wildfire it negligently caused.
In a published opinion, a three-judge panel rejected the company’s contentions that the government couldn't receive compensation for intangible, noneconomic damages and that it had failed to produce sufficient evidence to the jury, affirming a lower court’s decision that denied CB&I’s bid for a new trial.
