US, Calif. Agencies Can’t Duck San Fran Delta Pollution Suit

Law360, New York (September 04, 2012, 1:55 PM ET) -- A federal judge on Friday refused to toss a suit brought by California conservation groups against federal and regional authorities over the continued discharge of polluted agricultural drainage water into the San Joaquin River and San Francisco Bay-Delta.

U.S. District Judge Kimberly Mueller determined that the environmental groups, led by the Pacific Coast Federation of Fishermen’s Associations, had sufficiently argued that the drainage system constructed by the U.S. Bureau of Reclamation and the San Luis & Delta Mendota Water Authority could be considered “point source” pollution...
