NY Green Tax Incentives Could Spur State FCA Investigations

Law360, New York (January 25, 2013, 8:22 PM ET) -- Brand-new tax breaks for green buildings and solar installations in New York could accelerate a rush to install anti-global warming technologies, but businesses that are overly aggressive in claiming these incentives could become targets under the state's powerful false claims law, lawyers said Friday.

One tax incentive in particular, signed by Gov. Andrew Cuomo in July, could accelerate the use of local property tax exemptions for businesses that come into compliance with the widely recognized Leadership in Energy and Environmental Design certification process for green buildings....
