Individual Claims Retained Under DuPont Herbicide Settlement

Law360, Los Angeles (February 12, 2013, 7:25 PM ET) -- A Pennsylvania federal judge on Monday preliminarily approved a multimillion-dollar settlement in DuPont Co.'s multidistrict litigation over its now-recalled herbicide Imprelis that lets members of several classes maintain individual claims against the company and still receive reimbursement for damage to trees caused by the herbicide.

U.S. District Judge Gene E.K. Pratter on Monday signed off on the parties’ October motion for preliminary approval of the proposed class settlement, saying the deal stipulating DuPont's compensation for Imprelis users for trees unintentionally damaged by the weed-killer is reasonable....
