5th Circ. Urged To Nix Ruling Tying Policy To Bird Deaths

Law360, Houston (May 03, 2013, 6:10 PM ET) -- The state of Texas and a pair of river authorities asked the Fifth Circuit on Thursday to toss a district court's ruling that the state's water management practices caused the death of several whooping cranes in violation of the Endangered Species Act.

The Texas Commission on Environmental Quality, the Guadalupe-Blanco River Authority and the San Antonio River Authority argued in briefs filed with the Fifth Circuit that Senior U.S. District Judge Janis Graham Jack's decision interferes with the state's interest in establishing its own water regulations...
