Court Overturns Baltimore Law Against LNG Plant

Law360, New York (May 21, 2008, 12:00 AM ET) -- A federal appeals court panel has overturned a Baltimore County, Md., law that was passed to block a proposed liquefied natural gas shipping terminal and related pipeline.

In an opinion reached Monday, the U.S. Court of Appeals for the Fourth Circuit ruled that the Baltimore County law was preempted by the Natural Gas Act, which gives the Federal Energy Regulatory Commission the “exclusive authority to approve or deny an application for the siting, construction, expansion or operation of an LNG terminal.”
