EPA Coal Ash Rules May Hasten Power Plant Closures

Law360, New York (January 8, 2015, 12:40 PM EST) -- In keeping with its judicial commitments, on Dec. 19, 2014, the U.S. Environmental Protection Agency finalized national regulations that provide a comprehensive set of requirements for the "safe" disposal of coal combustion residuals (CCRs), commonly known as coal ash, from coal-fired power plants. While coal-fired power plants and those who beneficially use coal ash will undoubtedly be pleased with this decision, the new requirements may hasten the shutdown of some coal-fired power plants. Because the new rules provide for reduced closure requirements for surface impoundments that are "inactive" as of the effective date, coal-fired plants that were already planning to shut down in late 2015 or 2016 may do so sooner to take advantage of this provision....
