House Report May Taper Hopes For Clean Power Plan

Law360, New York (January 9, 2015, 10:43 AM EST) -- Climate change policy is a priority for the Obama administration. During the past few months, the administration has made several international pledges to cut U.S. emissions of greenhouse gases. The administration's ability to meet those pledges will turn on its ability to institute domestic regulatory programs aimed at reducing emissions. The White House hopes to achieve a large portion of those domestic reductions through the U.S. Environmental Protection Agency's proposal, the Clean Power Plan, to limit emissions from existing power plants. This proposed rule has received significant pushback from a number of parties, including a recently released report by the Republican-led House Energy and Commerce Committee majority staff. The criticisms raised in the committee report foreshadow the legal and political difficulties that the administration may face in meeting those international pledges....
