Groups Sue National Coal Over Selenium Dumping

Law360, New York (October 08, 2008, 12:00 AM ET) -- The Sierra Club and other environmental groups have sued National Coal Corp. for allegedly violating the Clean Water Act by dumping toxic selenium into rivers in Tennessee.

The lawsuit was filed Monday in the U.S. District Court for the Eastern District of Tennessee by the Sierra Club, Tennessee Clean Water Network and a group called Statewide Organizing for Empowerment. They allege that National Coal has repeatedly discharged selenium into various Tennessee waterways, harming the groups' members and other Tennessee citizens.
