Law360, New York (April 13, 2009, 12:00 AM ET) -- Although the U.S. Environmental Protection Agency is moving ahead with plans to regulate greenhouse gases under the Clean Air Act, any new climate bill is likely to strip the agency of that authority, according to politicians and attorneys following the matter.
Sen. Jeff Bingaman, D-N.M., said Friday at a Stroock & Stroock & Lavan LLP conference that a cap-and-trade program would be better than the EPA using its existing statutory authority.
