ORDER denying 154 Motion to Compel, in part without prejudice to renewal. After reviewing the documents in camera, the Court sustains the defendants' attorney-client privilege objections to the documents bearing Bates numbers PLHHC-BROWN-0009877, -0015411, -0015413, -0015599, -0015949, -0017464, and -0042128.As discussed during today's hearing, this leaves 113 documents as to which the plaintiffs have challenged the defendants' privilege claims, and which the Court has not reviewed in camera. A senior member of the defendants' litigation team is directed to re-review each of those privilege claims, laying eyes on all 113 documents, by August 21, 2026, and to certify to plaintiffs' counsel that s/he has done so. If that re-review reveals that some privilege claims are unsupportable, the defendants shall produce the corresponding document(s) to the plaintiffs by August 28, 2026. Additionally, plaintiffs' counsel shall identify to the defendants, by August 21, 2026, any documents within the group of 113 as to which counsel reasonably believes the defendants' privilege log does not adequately support a privilege claim. The parties are then directed to meet and confer over those privilege claims by August 28, 2026.If the foregoing steps do not resolve all the parties' disputes over the defendants' privilege claims, the plaintiffs may file another motion to compel, provided that it is filed by September 4, 2026. In the meantime the existing motion at ECF No. 154 is denied on the merits as to the twenty-four documents reviewed in camera, and denied as moot and without prejudice to renewal by September 4 as to the other 113 referenced in the motion.
