MINUTE entry before the Honorable Sunil R. Harjani: Telephonic motion hearing held. For the reasons stated on the record the following motions are stricken as unnecessary: Defendant Blitt and Gaines, P.C.'s combined motion to dismiss Plaintiff's first amended complaint 45 , Defendant Bank of America, N.A.'s motion to dismiss Plaintiff's second amended complaint 49 , and Plaintiff's motion to stay response 62 . Plaintiff's motion for leave to file third amended complaint 57 is granted as Plaintiff represented on the record a fourth amended complaint will not be filed. As this Court stated, Plaintiff should not keep filing new complaints, which is only serving to delay a decision as to whether this case proceeds to discovery or not. Plaintiff's third amended complaint is due 4/30/2024. Defendants answer or motion to dismiss is due 5/21/2024. Briefing schedule as to Defendants' motion to dismiss to follow upon filing of the motion. Defendant Bank of America, N.A. motion to stay discovery 63 is granted as to all discovery. Telephonic status hearing set for 7/16/2024 at 9:15 a.m. Members of the public and media will be able to call in to listen to this hearing but will be placed on mute.
