MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 5/24/2024.
Before the Court is the Unopposed 45 Motion for Clarification, in which Plaintiffs seek clarification as to whether the January 19, 2024, Order of the Honorable Andrew Gordon, United States District Judge, reassigning the matter of Aurora v. Hankins, 2:23-cv-02112-RFB-DJA, to the Honorable Richard Boulware, United States District Judge, resulted in consolidation of the Aurora, 2:23-cv-02112-RFB-DJA, matter with this case.
Federal Rule of Civil procedure 60(a) allows a court to clarify a judgement, order, or other part of the record to "ensure that the court's purpose is fully implemented." Garamendi v. Henin, 683 F.3d 1069, 1079 (9th Cir. 2012). The rule also "allows for clarification and explanation, consistent with the intent of the original [order]." Id. On August 14, 2023, the Court issued the 16 Consolidation Order in which cases 2:23-cv-00710-CDS-EJY and 2:23-cv-00824-RFB-DJA were consolidated with In re Hankins Plastic Surgery Associates P.C. dba Hankins & Sohn Plastic Surgery Associates, 2:23-cv-00824-RFB-DJA as the lead case. That Order provided further that "Any action subsequently filed, transferred, or removed to this Court that arises out of the same or similar operative facts as the Consolidated Action will be consolidated with the Consolidated Action for pre-trial purposes."
To ensure the Court's purpose in the 16 Consolidation Order is fully implemented, IT IS HEREBY ORDERED that the 45 Motion is GRANTED. While Aurora v. Hankins, 23-cv-2112-RFB-DJA, was transferred under the Transfer Order of Judge Gordon in Aurora v. Hankins, 23-cv-2112-RFB-DJA (ECF No. 10), the Court has not yet found that the Aurora matter "arises out of the same or similar operative facts as the Consolidated Action" nor has a Consolidation Order issued.
IT IS FURTHER ORDERED that on or before June 7, 2024, the Parties will file a submission regarding their positions on whether Aurora v. Hankins, 2:23-cv-02112, should be consolidated with this matter. Should any or all Parties seek consolidation, a Motion to Consolidate will be filed.
